Enforcement in the Republic of Moldova

Enforcement is the stage at which an enforceable title is put into effect: the debtor’s assets, accounts or income may be pursued as the law allows. Enforcement acts are carried out by the judicial enforcement officer. Collect.md prepares and follows the creditor’s file — we do not exercise the statutory powers reserved to the officer.

What enforcement is

Until there is an enforceable title, recovery is amicable or judicial work. Enforcement as a rule starts only once there is a title that can be executed — for example a final judgment or another instrument the law recognises for that purpose.

Without a title, an enforcement file is not opened. Mixing up “we sent a demand letter” with “we can garnish accounts” is common and expensive as an expectation.

The judicial officer’s role and Collect.md’s role

The judicial enforcement officer is the person authorised to carry out enforcement acts, within Moldova’s enforcement legislation. The officer identifies assets, applies measures (seizure, account garnishment and others provided by law) and pursues collection.

Collect.md represents the creditor’s interest: we check the title and the stage of the file, prepare the documents needed to open enforcement, communicate with the officer, follow reports and flag gaps. We do not seize assets, garnish accounts or sell property — those acts are not ours.

Usual measures, at a high level

Depending on the file and what can be identified, enforcement may target movable or immovable assets, bank accounts, income or the debtor’s claims against third parties. The aim is collection, not “punishing” the debtor.

Which measure is possible, and in what order, is for the officer to decide under the law and the facts — not a menu the creditor picks overnight.

  • Identifying assets and accounts
  • Seizure or garnishment, where the law allows it
  • Realising attachable assets, where appropriate

When assets are found — and when it looks as if there is “nothing”

If assets or accounts are identifiable, the officer can apply the measures provided by law, and collection depends on the real value of what was found, on encumbrances and on challenges.

If the debtor “has nothing in their name”, the file does not close automatically. Sometimes checks are incomplete, sometimes assets sit with third parties, sometimes further legal analysis is warranted. Those situations have their own guides; we flag them here without repeating them step by step.

Feasibility and costs of enforcement

Enforcement involves costs (fees, the officer’s remuneration, possible expert reports) and a duration that depends on identifiable assets, on institutions and on challenges. A file with clear assets is not the same as one where the debtor has been stripped of property.

Before opening enforcement, a review is worth it: is the title enforceable, does the debtor still exist, are there signs of assets? Sometimes the answer is to proceed; sometimes it is not to spend money on a file with no practical prospect.

Do you already have an enforceable title?

Send the judgment or title and the debtor’s details. We will check whether enforcement can be opened and what follows — including if the estate looks empty or there are signs of moved assets.

Frequently Asked Questions

Can I ask for garnishment if I have only sent a demand letter?

Not as a rule. A demand letter is not an enforceable title. Enforcement requires a title recognised by law. We assess the stage of the file before talking about garnishment or seizure.

Is Collect.md a judicial enforcement officer?

No. The judicial officer carries out enforcement acts. We represent the creditor: preparation, follow-up, communication with the officer. We work with officers; we do not take over their powers.

How long does enforcement take?

Duration varies from file to file: identifiable assets, accounts, challenges, insolvency. We do not display a standard range as if it applied to every case. After reviewing the title we can say what is realistic in your situation.
