A payment demand is a formal request to the debtor: it identifies the debt, its basis and a time for payment. It is not a court judgment and not an enforcement title. For a creditor with an unpaid invoice or contract, it is often the step that moves the file from a simple reminder to documented recovery.
In practice a demand letter is a written request for a defined sum, explaining why the debtor owes it and leaving time to pay or to give a substantive reply.
A well-prepared demand helps the later file: it shows that payment was clearly requested before court. It does not replace a judgment and does not, by itself, open enforcement.
It is useful when the claim can be identified (amount, contract or invoice, debtor) and a simple reminder has not produced payment or a serious reply. It is not mandatory in every file in the same form; timing depends on the documents and the communication history.
If the debtor disputes the basis, the amount or delivery, a demand can still be sent, but it must match what you can prove — not a rounded-up figure.
A payment reminder is operational communication: email, a call, a message. It may restart payment, but its evidential weight is limited if it is unclear and not kept.
A payment demand is the formal written request, with a legal basis and a deadline. It remains an act of the creditor, not a court judgment.
A court payment order (ordonanță) is a separate judicial procedure, with its own conditions, which may lead to a title without a full trial on the merits. We do not treat it as a demand letter and do not summarise that procedure here.
Before drafting, so far as the file allows, we check: the parties’ identity, the amount claimed, the basis (contract, invoice, handover act), payments already made and prior correspondence. The demand should leave the debtor a concrete time to pay or to reply — the creditor sets that time according to the file, not a single statutory deadline for every situation.
The wording must be precise: who owes, how much, why, by when. Vague language or unjustified amounts weaken both negotiation and any later case.
After sending, we keep proof of transmission and watch the deadline. The debtor may pay, propose instalments or contest the claim. If they stay silent or refuse without basis, the file can move to legal recovery — a court action or, where the conditions allow, other judicial procedures.
The demand sits between amicable recovery (communication, negotiation) and legal recovery. It does not guarantee payment and does not replace advice on the next step in your file.
Send the contract, invoices and correspondence with the debtor. We will say whether a demand letter is the right step now and what it should cover.
Request a demand letterNo. A demand letter is a formal request by the creditor. Enforcement as a rule requires an enforceable title (for example a final judgment). Mixing up a demand with a title leads to the wrong expectations.
No. The creditor sets in the demand a time to pay or to reply, according to the file. We do not present a “universal” deadline as if it were the same legal duty in every case.
We assess the reply (or the lack of one) and the documents. The next step may be further negotiation, a court action or, where appropriate, a specific judicial procedure. There is no single automatic path.
