Legal basis

Art. 942 of the Civil Code: if a sum of money is not paid when due, the creditor is entitled to late payment interest equal to the NBM base rate plus 9 percentage points per year (5 pp if the debtor is a consumer). Where the contract has a penalty clause, the creditor chooses either the interest or the penalty (Art. 942(4)).

Indicative calculation, not legal advice. Interest runs from the day after the due date up to the chosen date; each period uses the NBM base rate in force; 365-day basis. Rate source: National Bank of Moldova. Updated 12/10/2026.

How late payment interest is calculated

Late payment interest is owed for every day a sum of money stays unpaid after its due date. It arises directly from the law (Art. 942 of the Civil Code), so it can be claimed even when the contract says nothing about it. It is not a contractual penalty: it is statutory interest, counted in days, until actual payment.

Formula for each period: amount owed × annual rate × days / 365. The annual rate is the National Bank of Moldova base rate plus 9 percentage points when the debtor is not a consumer (typically business-to-business), or plus 5 percentage points when the debtor is a consumer.

Because the NBM changes its base rate, the delay is split into periods and each period uses the rate in force on that day. The calculator does this automatically and rounds each period to bani (two decimals).

Principal stays constant between payments. On a partial payment, accrued interest is cleared first by default, then capital. You can reverse the order under Advanced options. A lawyer should confirm the allocation rule for your file.

Example

A debt of MDL 100,000 due on 15/01/2026, calculated on 12/10/2026: 270 days late, 5 periods with different NBM rates. For a business debtor, late payment interest is MDL 11,369.86 and the total to recover is MDL 111,369.86. The same case with a consumer debtor yields MDL 8,410.97 of interest.

When +9 applies and when +5 percentage points apply

Article 942 distinguishes two situations. When the debtor is a consumer — typically an individual who contracted outside a professional activity — the margin is 5 percentage points above the NBM base rate. In other cases, including between companies, the margin is 9 percentage points.

Choose the debtor type correctly before a demand letter. A 4 pp error on a large claim and a long delay changes the sum substantially. If the debt already carried contractual interest before the due date, you may replace the NBM rate with the contractual rate; the 9 or 5 pp margin is still added.

Interest or penalty: choose one

If the contract stipulates a penalty, the creditor may claim either late payment interest or the late-payment penalty, not both for the same delay (Art. 942(4)). Enter the daily percentage under Advanced options to see, for the same periods, which option is larger before a demand letter or a court claim.

Legal basis

Frequently asked questions

What is late payment interest?

The amount a debtor owes for every day a sum of money stays unpaid after its due date (Art. 942 Civil Code). It arises from the law and does not need a contract clause.

What is the rate now?

The NBM base rate is 9% (since 17/09/2026), so late payment interest is 18% per year for businesses and 14% per year when the debtor is a consumer.

From what date does interest run?

From the day after the due date until the day of payment, inclusive. Day count is actual/365.

Can I claim both a penalty and interest?

Not for the same delay. If the contract has a penalty clause, the creditor chooses either late payment interest or the penalty (Art. 942(4)). The calculator can compare them.

What if the debtor paid part of the debt?

Add the payments under "Advanced options". By default each payment covers accrued interest first, then principal.

Can I use the contractual interest rate?

If the debt carried contractual interest before the due date, the creditor may replace the NBM base rate with the contractual rate; the 9 or 5 pp margin is added the same way.

Is the calculation legally binding?

It is an indicative calculation following the statutory rules. For a court claim we recommend a lawyer's review.

How do I recover the amount?

Payment demand letter, then a court order or a lawsuit, then enforcement. Collect.md handles the whole process, with a fee only on results.
