How it was calculated

  1. 01Due date 15/11/2023: the 3-year period runs until 15/11/2026.

Indicative calculation, not legal advice. Conventions: a period in years ends on the same calendar day (29 Feb → 28 Feb); the deadline is not moved to the next working day. Special periods or transitional rules may change the result.

The general period: 3 years

The right to sue for a debt is, as a rule, time-barred after 3 years (Art. 391 Civil Code). For a money debt the period starts on the due date. If no payment date was set, it starts when the creditor demands payment (Art. 395).

What restarts the period

The period is interrupted and starts again from zero when the debtor acknowledges the debt — in writing or by conduct: a partial payment, paying interest or penalties, asking for more time, providing security. A court filing also interrupts it: a lawsuit, an arbitration claim or a court order application (Art. 401). An acknowledgement works even after the period has expired.

What does NOT restart it

A demand letter or notice to the debtor does not interrupt limitation. It is useful as evidence and as an invitation to pay; if the debtor replies acknowledging the debt, that reply interrupts the period.

When it is extended (suspension)

Negotiations or mediation with the debtor, force majeure and the other grounds in Art. 398 suspend the period only if they fall within its last 6 months. Once the cause ends, the remaining period is extended to 6 months. Suspension can never push the period beyond 10 years from the breach (Art. 404).

Frequently asked questions

What is the limitation period for a debt in Moldova?

The general period is 3 years (Art. 391 Civil Code), usually counted from the due date.

Does a demand letter interrupt limitation?

No. Limitation is interrupted by the debtor acknowledging the debt or by a court filing (Art. 401). A demand letter is useful as evidence.

Does a partial payment restart the period?

Yes. A partial payment is a tacit acknowledgement of the debt, and the 3-year period starts again from the payment date.

What if the period has expired?

The debt is not extinguished. The court dismisses the claim only if the debtor raises limitation (Art. 394). If the debtor pays voluntarily, they cannot claim the money back (Art. 406).

Do negotiations stop the clock?

They suspend it only if they take place in the last 6 months of the period; afterwards you have at least 6 months left (Art. 398).
