How to send it properly

  • Send it by registered post with acknowledgement of receipt, or hand it over against signature. Keep the proof.
  • A demand letter does not interrupt limitation. If the debtor replies acknowledging the debt or asking for more time, keep the reply — that is what interrupts the period (Art. 401 Civil Code).
  • If the contract has a penalty clause, claim either the penalty or late payment interest — not both for the same delay (Art. 942(4)).

Frequently asked questions

Is a demand letter required before going to court?

Not always, but it is recommended: it shows good faith, fixes the amount claimed and often settles the matter without a lawsuit.

What deadline should I give the debtor?

Usually 5–10 working days from receipt. A short but reasonable deadline signals that you are serious.

Can I claim late payment interest?

Yes. Late payment interest arises from the law (Art. 942 Civil Code) even if the contract is silent. The generator calculates it automatically.

Does the demand interrupt limitation?

No. The period is interrupted only by the debtor acknowledging the debt or by a court filing (Art. 401 Civil Code).
