Recovering debts from individuals

The commercial-claims page is for debts between companies. This page is about a sum asked of a private person: a loan, rent, an invoice to an individual. The rules are stricter, the evidence looks different, and aggressive methods can cost more than the claim. Collect.md takes such files when the amount and the documents justify pursuit — typically above a practical threshold discussed at review.

When it makes sense to pursue an individual

It makes sense when the claim can be identified, you have evidence (a contract, a receipt, a transfer, an acknowledgement) and the debtor is not, from the outset, without income and without attachable assets. Very small sums with no papers rarely justify court. At review we say whether the file clears the practical threshold — not a slogan that “we recover everything”.

What you may do lawfully — and what you may not

You may request payment in writing, negotiate, agree instalments, go to court and, after a title, open enforcement through an officer. You may not harass, threaten, publish the debt, take goods by force or “report to a credit bureau” if you are not a creditor authorised to do so. Collect.md works only on the lawful path; we refuse mandates that ask for something else.

  • A written demand, with a basis and a deadline
  • Negotiation and a payment plan if the debtor replies
  • Court action when the evidence holds
  • Enforcement after a title, through a judicial officer

What evidence we usually need

Loans between people rest on a receipt, a contract, a transfer or an acknowledgement. Rent — on the contract and a record of arrears. An invoice to a private person — on a delivery or acceptance act. With no written trace, pursuit is hard; the articles and document templates on the site show what you can reconstruct before you send us the file.

Why this is not the same as B2B recovery

A private person has protections on income and on goods needed for daily use; “disappearing” is easier than for a company with a seat and an account. That is why we do not promise collection and do not use methods that breach private life. For invoices between companies, use the commercial-claims page.

Do you have a claim against a private person?

Send the papers you have (receipt, contract, transfer, messages). We will say whether the file is worth pursuing lawfully — and from which step.

Frequently Asked Questions

Do you work with individuals or only with companies?

Primarily with companies. We also review individuals’ claims when the amount and the papers justify pursuit — typically above a practical threshold (around MDL 5,000 as a guide), confirmed at review.

I lent money without a receipt. Is it still worth it?

It depends on other traces: a transfer, messages, witnesses, a later acknowledgement. With no evidence at all, court is hard to sustain. Read the guide on loans without a receipt and send what you have — we will say whether it is worth starting.

Can you call the debtor’s family or workplace?

Not as a pressure method. We communicate with the debtor, through lawful channels. Disclosing the debt to third parties without a basis can cost more than the claim.
