The debtor left the country: how to recover the debt

In short

Leaving Moldova does not wipe out the debt. What to do at once, what remains reachable here, and why waiting “until they come back” costs time — including limitation. The obligation remains. It does not vanish with a plane ticket, and it does not vanish because the family says they no longer live here. What changes is where you can still pursue it: assets, accounts, income or an address — usually still in the Republic of Moldova. Start with the file here: gather the evidence, note the last known address, and ask in writing for the sum to be confirmed. The ordinary limitation period is 3 years. Waiting “until they come back” does not stop the clock.

In Moldova files the line comes up often: “They left. They’re in Italy / France / on a site. There’s nothing I can do.” Leaving does not cancel the claim. It only changes where you still have leverage — and how expensive waiting is.

Below is a practical order: what to check today, what to do in-country, and what is not worth trying. Orientation, not legal advice on your file.

1. Leaving does not wipe out the debt

The obligation remains. It does not vanish with a plane ticket. It does not vanish because the family says “they don’t live here any more”. What changes is where you can actually pursue: assets, accounts, income, an address — usually still in the Republic of Moldova, at least at first.

For an individual, the legal limits stay those in the guide to recovering from private persons: no harassment, no public posts, no pressure on relatives. For a company, check whether the director left while the company is still active — B2B recovery has its own commercial claims page.

2. What to do in 48 hours

Do not start with “I need a lawyer abroad”. Start with the file here.

  • Gather the evidence. Contract, receipt, invoices, transfers, messages that admit the sum. If the loan has no paper, see the Romanian guide on proving a debt without a receipt — and do not delete the chat.
  • Note the last known address in Moldova, any local job, the account you paid into, contacts that still reply.
  • A calm written message. Ask them to confirm the amount and a payment date. An admission is evidence; it may also interrupt limitation. Threats or public shaming weaken your position.
  • Do not wait for a return. The ordinary limitation period is 3 years (Civil Code art. 391). “When they come back” does not stop the clock. Check the file with the limitation calculator and the guide to the limitation period.

3. What remains reachable in Moldova

Many debtors leave traces here: an apartment in their name, a share with parents, an account at a Moldovan bank, wages or a pension paid locally, a company they still appear in, a vehicle. Enforcement after a title is done by a judicial officer against assets and income that are found — not against a person in an airport. The procedure is on the enforcement page. If you already have a title and “nothing is found”, read what to do when the bailiff finds nothing.

Without a title there is no garnishment. A demand letter does not open enforcement. The order stays: evidence → amicable recovery → court where needed → title → enforcement. The comparison of stages is in the Romanian guide amiabilă vs. instanță; the commercial chain is on stages of recovering a debt.

4. Court in Moldova even if they are not here

The case does not require the debtor in the room. Non-appearance does not “cancel” the action. What matters in practice is venue, service at the last known address, and the quality of the papers. An empty claim, with no identifiable sum and no evidence, is not cured by “they ran away”.

For documented, uncontested claims, a court payment order is sometimes the fit — the Romanian guide is ordonanța judecătorească. Otherwise the path is an ordinary claim; the court stage is described on legal recovery. Service abroad, if needed, is a procedural stage: it takes time, it is not a shortcut, and it should not be improvised from a tutorial.

5. Pursuit abroad: a realistic expectation

A title obtained in Moldova is not enforced automatically in another state. Recognition and enforcement there depend on the law of the place where the assets are, on treaties and on the form of the documents. It is a separate path, often slower and more expensive than pursuing what remains in Moldova. Do not make it the first move “so we can reach them there”.

In practice it is worth discussing when the sum justifies the cost and there are concrete signs of assets or income in that state — not a rumour that “they work in Italy”. Until then, work the file here.

Common mistakes

  • Waiting for a return while limitation runs.
  • Pressure on family, employer or social media — unlawful and counterproductive.
  • Skipping the demand letter and the evidence, “straight to a lawyer in their country”. Without an internal file, nobody abroad has anything to work with.
  • Treating a WhatsApp message as an enforceable title. The message is evidence, not a garnishment.

In short

The debtor may be far away; the claim usually is not. Gather the evidence, write, check limitation, see what is reachable in Moldova, then decide on court. Enforcement in another country is a later stage, not a reflex. Send the papers: we will say what can be pursued from here — no upfront fee, no pressure. To hand over amicable pursuit: amicable recovery; for the court stage: legal recovery.
