MDL 200.00

How it was calculated

MDL 2,050 + 3% × (100,000 − 50,001) = MDL 3,549.97

The state fee and the stamp duty can be claimed from the defendant as court costs. With several distinct claims the state fee is due for each (Art. 6(4)) — add them with "Add a claim".

The 200 lei stamp duty is paid once per application, however many claims it contains, both at first instance and on appeal, recourse or revision (Art. 2(1), Law 213/2023). It is not refunded except in the cases of Art. 7(3). If you win, it can be recovered from the losing party together with the other court costs.

Indicative calculation based on Law 213/2023 as in force since 1 January 2026 (Annex 1), checked on 13 October 2026. Not legal advice. Check the exemptions in Annex 2.

Frequently asked questions

What is the fee for a MDL 100,000 claim?

About MDL 3,550, plus the 200 lei stamp duty.

How much is an appeal?

85% of the fee on the contested amount (monetary disputes) or of the first-instance fee (other cases, e.g. MDL 212.50 for a non-monetary claim), plus the 200 lei stamp duty (pt. 1.16; Art. 2(1)).

Is the stamp duty paid on appeal?

Yes. Art. 2(1) of Law 213/2023 provides for it at first instance and on appeal. The Centre Court of Appeal required it for an appeal, and the Constitutional Court treated this as a matter of applying the law (decision no. 69 of 30 April 2026).

What if the action has several claims?

The state fee is calculated for each claim and added up (Art. 6(4)); the stamp duty is paid once.

Has the court fee law changed?

Yes, several times. The latest change took effect on 1 January 2026 (Law 187/2025): refund requests for the state fee go to the State Tax Service within 3 years. The claim scale, the appeal, recourse and revision percentages and the 200 lei stamp duty are unchanged.
